Currently, PHLEARN uses the following third-party services, which each have their own privacy policies: Google Analytics, Facebook Analytics, Chartbeat, Crazy Egg, Help Scout, Sendgrid, Brightcove, YouTube, Linkedin, Twitter, Pingdom, Mailchimp, Jilt, OneSignal, OptinMonster, Fomo, Kinsta, and Cloudflare.
If you send us an e-mail with questions or comments, we may use your personal information to respond and emails are stored for future reference.

Information We Share with Third Parties
PHLEARN collects data that is critical to the function of our Services and delivering the best experience possible. As a general rule, we will not share or otherwise disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as we believe in good faith that the law requires it or under the following circumstances: 1) Under a confidentiality agreement, we may match user information with third-party data. 2) We may disclose aggregated user statistics (for example, we have customers in 148 countries) in order to describe our Services to prospective partners, advertisers, and other third parties, and for other lawful purposes.
Sharing by You
You will have the ability to share your User Content with another user(s). If you share your User Content with anyone, we shall have no liability to you (or anyone you share your User Content). We will not make any User Content that you keep private and do no share available to any third party except to a third party authorized by you to access such information or if the law requires.

You may edit your personal account information with PHLEARN at any time by using your unique identifier and password and accessing your Account page.
Please be aware that it is not possible to remove every record of the information you have provided to us from all of our systems. For security reasons, the secure backups of our system’s information to prevent data loss will mean that a copy of your information may still exist in some form that will be difficult or impossible for us to locate or delete. After receiving your request, all personal information stored in databases we actively own and control will be updated, corrected, or deleted, as appropriate, as soon as and to the extent reasonably and technically possible.
Protecting Your Information
Your personal account information with PHLEARN is password protected so that you and only you have access to this personal information and the User Content therein. We recommend that you do not disclose your unique identifier or password to anyone. Also, remember to sign out of your account and close your browser window when you have finished using our Services. This is to ensure that others cannot access your personal information or User Content.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our online Services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.

For example, PHLEARN sends welcome e-mail after you create an account, when you signup for our newsletter, when you enter a contest on our website, and when you purchase any product on our website. Outside Service Providers & Third-Parties
We may employ third party companies, outside service contractors, vendors, and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used. For example, these services may include our website hosting (Kinsta), credit card processing (Braintree & PayPal), and our mailing list (MailChimp & Sendgrid).

PHLEARN may disclose your information if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order, or another valid legal process. PHLEARN.COM “KIDS” NOTICE
PHLEARN will not solicit and does not intend to collect personal information from people under eighteen (18) years of age. We will specifically instruct people under eighteen (18) not to submit personal information on the Web Site. If a person under eighteen (18) provides us with personal information and that person’s parent or guardian wants it removed from our records, the parent or guardian should contact us by sending an email to email@example.com. CA Residents Only – California Consumer Protection Act

Right to Request

Data Processing Addendum (“DPA”)
To comply with the EU’s General Data Protection Regulation (“GDPR”), we have updated our internal data collection policies to adhere to those outlined in the GDPR.
“PHLEARN”, “we”, “us”, or “our” refers to the owners of the PHLEARN website and services, (collectively referred to as the “PHLEARN.”).
“User” or “You” or “Customer” refers to the customer or user that signs up to use PHLEARN.
“Party” refers to PHLEARN and/or the Customer depending on the context.
1. Personal Data Protection Policies
- Each party agrees that personal data shall be treated as confidential information under this DPA.
- Personally identifiable information shall remain the property of the disclosing party. PHLEARN recognizes that User is the controller and maintains control over personal data.
- PHLEARN will process User’s personal data only to the extent strictly necessary for the purpose of providing the services in accordance with our Terms of Service and any further written instructions from the customer that are mutually agreed upon in writing.
- PHLEARN Will:
- Implement and maintain a reasonable and appropriate security program comprising adequate security, technical and organizational measures to protect against unauthorized, unlawful or accidental processing, use, erasure, loss or destruction of, or damage to, customer personal data.
- Not modify, alter, delete, publish or disclose any customer personal data to any third party, nor allow any third party to process such personal data on PHLEARN behalf unless the third party is bound to similar confidentiality and data handling provisions.
- Only allow give access to customer personal data to employees, contractors, and vendors on a “need-to-know” basis to the extent necessary to perform its obligations under the Terms of Service.
- Only process customer personal data to the extent necessary to perform its obligations under the Terms of Service, upon written instructions of the customer (only as mutually agreed upon), and in accordance with applicable laws.
- Notwithstanding any other provision, we partner with third parties that collect information across various channels, including offline and online, for purposes of delivering more relevant advertising to you. Our partners may place or recognize a cookie on your computer, device, or directly in our emails/communications, and we may share personal information with them if you have submitted such information to us, such as your name, postal address, email address, or device ID. Our partners may link the nonpersonal information we share with them to the cookie stored on your browser or device, and they may collect information such as your IP address, browser or operating system type and version, and demographic or inferred-interest information. Our partners use this information to recognize you across different channels and platforms over time for advertising, analytics, attribution, and reporting purposes. - Upon termination of your account PHLEARN will delete, destroy, or anonymize the personal data in accordance with our standard backup and retention policy per the Terms of Service This process shall occur within 60 days. If we are required to retain personal data due to Union, Member State, or United States laws, then PHLEARN reserves the right to retain personal data.
2. Information Breaches and Incidents
- When either party becomes aware of an incident that impacts the processing of personal data, it shall promptly notify the other. Parties agree that they shall reasonably cooperate in order to enable the other party to perform an investigation, craft a response, and to take necessary steps in regards to the incident.
- Any notifications made under this section shall be made to firstname.lastname@example.org. Please include a description of the nature of the incident, the name and contact details of the point of contact where more information can be obtained, a description of the incident; and measures taken or proposed to be taken to address the incident.
3. Liability and Indemnity
- Each party indemnifies the other and holds them harmless against all claims, actions, third party claims, losses, damages and expenses incurred by the indemnified party and arising directly or indirectly out of or in connection with a breach of this DPA.
